South Dakota's Laws on Squatters: What Homeowners Need to Know

Squatters can only be removed from a property after the court grants the owner an order for possession. This process is usually initiated by the owner by starting legal proceedings. The owner must first prove that they are rightful owner of the property before anything happens. After this, the court can issue an interim possession order, allowing the owner to access the property, secure it, and then proceed to a hearing. The squatters can either negotiate to leave the property or attend the court hearing. In some cases, the court may order squatters to leave the property. If they fail to comply, the police may be involved.
